Terms and conditions

These terms are the agreement between you and Pyxel Route (Pvt) Ltd (company number PV00372199), registered at Colombo 09, Sri Lanka, for the use of Book-ah.

Using the service means you accept them. They are written to be read, so please read them.

What the service is

Book-ah is booking and property management software: a direct booking website, a front desk, rate plans, invoicing, and a channel connection that publishes your rates and availability to booking sites you choose.

We host it and keep it running. You use it to run your property.

Your account

You must be 18 or over and able to enter a contract.
Give us accurate details and keep them current, particularly billing ones.
You are responsible for your account and for what the staff you invite do in it. Keep passwords to yourself.
Tell us promptly if you think somebody has got in who should not have.

What you may not do

Break the law with it, or use it to help somebody else break the law.
Try to access another customer workspace, or probe the service for weaknesses without our written agreement.
Resell or rebrand the service as your own without our written agreement.
Load content you have no right to load, including photography that is not yours.
Deliberately overload the service or the channels we connect you to.

Fees and billing

Each plan has a monthly price and may have a yearly price, as shown on the pricing page when you sign up. If you choose the OTA connection, it is charged per connected property on top, at the price for the same interval. We take no commission on your bookings.
Monthly plans are invoiced monthly in advance. Annual plans are invoiced once a year in advance, at the yearly price. We tell you 30 days before an annual plan renews, and send its invoice 14 days before, due on the renewal date.
The OTA connection is billed for the properties connected at the start of each invoice period. On a monthly plan, connecting or pausing a property changes what you pay from the next invoice. On an annual plan, the year is paid for the properties connected when it starts, and each property connected during the year is invoiced for the rest of that year, pro rata. Disconnecting a property during the year is not refunded; it stops counting at the next renewal.
Invoices are payable on the date shown. We may suspend an account that is significantly overdue, after telling you first.
Prices are quoted in USD and can be billed in LKR on request. Taxes are added where the law requires.
We can change our prices. If we do, we will give you at least 30 days notice and the change will not affect a term you have already paid for.

Refunds

Refunds are covered by our refund policy, which forms part of these terms.

Your data, and your guests

Your bookings, guests, rates and content remain yours. We claim no ownership of any of it.
You grant us the licence we need to host, back up and display it in order to run the service, and nothing wider.
You are responsible for having the right to hold your guests data and for telling them what you do with it.
You can export your data at any time. Ask us and we will help.

Channel connections

Where you connect a booking channel, you are also bound by that channel agreement with you. We pass on the rates and availability you publish and bring back the reservations they send.

We are not responsible for a channel changing its rules, its fees, its interface, or for it approving or refusing your listing.

Availability

We work to keep the service available and we will give notice of planned maintenance where we reasonably can. We do not promise it will never be down, and we do not currently offer a contractual uptime guarantee. If we ever do, it will be written here.

Intellectual property

The software, the Book-ah name and the branding are owned by Pyxel Route (Pvt) Ltd. Using the service does not transfer any of it to you.

Do not copy, decompile or reproduce the software, or use our name or marks, without our written permission.

Limitation of liability

To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, including lost profit, lost bookings or lost goodwill.

Our total liability to you in any twelve month period is limited to the fees you paid us in that period.

Nothing here limits liability that cannot be limited by law.

Ending the agreement

You can cancel at any time. There is no exit fee and nothing to sign.
Cancelling stops the next renewal. It does not, by itself, refund a term already paid for. See the refund policy.
We can suspend or close an account that breaches these terms or that is significantly overdue, after telling you first except where the breach is serious enough that we cannot.
After closure we will make your data available for export for 30 days, then delete it apart from what we must legally keep.

Changes to these terms

We may update these terms. The date at the top changes when we do, and we will email you about anything material at least 30 days before it takes effect. Carrying on using the service after that means you accept the change.

Governing law

This agreement is governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute.
